Greetings all....

I am initiating a lawsuit against Uncle Pervey (yes, of course I know his real name) for libel and tortious interference with a business. I would appreciate anyone willing to give a sworn statement as to the length of time U.P. has been disrupting this board, and most importantly, the contents of the messages they have seen. Unfortunately, this applies only to U.S. members at this time, so thanks foreign guys, but you can't help on this one...

Okay, the question has been asked if you need anything other than your word as proof...

The answer is NO...this is not a criminal case, it's civil, meaning it will be decided on a preponderance of the evidence. I already have offending comments screen capped and video taped with IP's, so what I'm looking for here is basically eye-witness statements for the past year he's been around...don't worry, you won't have to appear in court, and all statements can be given on the phone (I'll pay for the calls)...you'll need to sign a printed copy and return it in a prepaid FedEx envelope (one person was worried about cost...there are NONE)...

Thanks for the help so far, guys...please keep it coming! All monies collected from the lawsuit will be used to fund a FREE facesitting party for everyone to attend....free facesitting for everybody! :cool:

I've always wondered -- is Pervey some underage pre-pubescent, or is he actually a grown man? I've never been able to discern this, but it would be all the more humorous (although even more sad) to find out he's actually a grown man. Perhaps living in his parents basement?

Edit: Btw, John -- if you don't mind my asking, and if it's not undiscloseable information -- how much exactly are you suing for?

Thanks for the offer of support...I am awaiting more info from my attorney on the depth of information that will be required in order to go for a summary judgement, which essentially means "Look, here's the facts, here's what he posted, it can't be denied because we have the logs and support from the provider so a trial is pointless because there is no disputing the evidence"
It's used when there is no disputing the material facts of the case and the injured party is entitled to the judgement as a matter of law....

re: an amount - undecided at this time. This is a real recent decision I was forced into making by his actions, so there is still a load of due diligence to be done as far as assets to be seized pending judgement, etc...so unfortunately, I can't say for sure yet.

Fortunately, Jeff has a bunch of old posts and logs saved that I never even saw (although I heard about them) with Pervey trying to insinuate that I'm involved with organized crime (LOL) and other criminal activities....

All put together, it will be plenty....but the stronger the case can get the better our chances for summary judgement, so please do send me those emails to webmaster@mistressdestiny.com so we can get this creep once and for all... :machine:

as al-uk says, if there's such a funding need, i can easily mail a check from Canada for that. he nearly closed the two main FS boards i visit. i had also assumed he was quieter, but then there's been some strange user posts on DFSB from time to time, that are very much like his spelling and grammer.

if we can get rid of his childish ways for good, it's money well spent IMO.

Under_it : Pervey wasn't really quiet, there's just been a better watch out for him now...most of the things he posts don't tend to get seen...most of them are the normal retarded anti-facesitguy messages he loves to post, but now he has a problem with ME, because I refused to believe his word over Facesitguy....so now he's threatened to ruin the forum (tortious interference), used libel references so heinous I don't care to repeat them (these are the ones that are really gonna nail his ass to the wall...the court precedents are HUGE in this area), threatened bodily harm and death (criminal cases should we decide the police need to be involved), etc...

The guy has serious issues. I warned him to stay away and he didn't want to listen, so I really have no choice...

i feel like i must respond to this thread because the lies are so blatent and with out any basis whatsoever. i know i don't have any support here because my reputation has been manufactered by john aka facesitguy over the past couple of years. as many of the people who were on the old board know i had a running fight with facesitguy. this went on for months and months. i finally grew tired of that pointless,stupid fight and quit posting for about three or three and a half months. i was quite suprised to check the board from time to time and there i was. uncle pervey was posting about gays and animal sex without me even touching my keyboard. now john, in the email that has not been revealed to you, blames this on an old diamond international empoyee that has since been terminated. before that i took the full and total blame. jeff, who was just a bit more reasonable now took over the board and even though we had issues about the facesitguy issue we were finally able to resolve it by me not posting about the facesitguy and as most of you will remember he took down the uncle pervey hate banners. i think i was able to make peace with him and the others who supported facesitguy. after the banners came down i no longer posted anything to the board or any other board. i think smelly,charlie, even sitter and chair can attest to this fact as i have not been on their board since i made my promise to jeff. when this new board came along, little did i know that facesitguy and john were one and the same. as i love facesitting i decided to try and join the board but i was very much unaware of the trap that was waiting for me. i mailed john before i attempted to join the board and told him about my reservations about facesitguy. he said and i quote " don't post any hateful messages about facesitguy and there will not be a problem. i then joined the board and as all of you know there is a little profile you must fill out first having to do with what you like, want to see etc. i filled it out, joined the board and did not come back for about three or four days. when i did the profile had been changed to-------yes, you guessed it, more fag and animal sex. in my emails to john/facesitguy he basically said tough shit and learn to live with it. get him to post the profile and then the altered one and i think anyone with half a brain will see the truth here. learn the truth before you make a judgement.

Pervey -- I don't know how long it took you to fabricate that story, then type it into your post, but rest assured, it was likely time you should have spent talking to your lawyer briefing over the charges John has lain against you, and preparing for your court case.

The sad part about this whole thing, is that I can actually see Pervey getting away with all this....by being declared as severely mentally unstable, and unable to conduct himself in a socially acceptable way. Truly sad.

Shakespeare said all the world is a stage, and I say all the world is a ball of string...one slowly loses its place and soon enough the whole thing begins to unravel...I gotta say, some of this was as influential and traumatic as it was laughable and trivial...one, I don't think john would win a case legally based on what I heard here unless the meat of the issue was true and it could be shown with intent (not just paper copies) that this u.p. was attempting to sabotage john's business (diamond international I presume? I am a huge fan of smother.com and would LOVE to and so need to reinstate my membership)...but there would definitely and should definitely be some sort of restraint and/or penalties placed on u.p. for any kind of continual personal harassment, for obvious reasons...if that keeps up, then let the cops do the rest...all being said, I was appalled to see how a fetish forum could cross that delicate (all too delicate at times) boundary into civil litigation...and as a result, the forum I'm posting in now exists of all things...I guess another delicate boundary that should always be respected is the ANOMYTITY AND IMPERSONAL NATURE OF ONLINE COMMUNICATION until BOTH parties agree on taking things to the next level...ha how I do so remember those heated (and at times) threatening debates while playing the online computer game STARCRAFT (for those who know what I'm talking about)...anyway, I'm glad the whole thing is over and I hope there are no more fiascos at any of these forums...as one of my favorite teachers said (well obviously not the "ASS" part lol) , just remember to do the following:
